Blame Apportioned in Ship Collision
The Board of Marine Inquiry wrapped up its four-day investigation into the recent collision at the entrance to Manila Bay by blaming both ships. The Board recommended the permanent revocation of the licenses of the captain and chief mate of the wooden-hulled San Nicolas as well as suspension for 6 months for the captain of the Super Ferry 12. Neither ships reduced speed when faced with a potential collision course nor sounded their horns. There were other irregularities as well that were cited in the report. Nothing has appeared so far in reports regarding the possible overloading of the Palawan ferry nor the false manifest. The press has also pointed out that under local regulations, wooden hulled vessels are prohibited from sea journeys beyond six hours.
The Board of Inquiry can only recommend administrative sanctions in cases where it finds fault. It has no power to impose penalties although its findings can be used as evidence in criminal or civil proceedings before the courts.
