The
Philippines became a member of the World Intellectual
Property Organization [WIPO] in 1980 and is
a signatory to a number of significant multilateral
for the protection and promotion of intellectual
property rights. Among the more important
of these are the following:
- The Convention Establishing the World Intellectual
Property Organization [since 1980]
- Paris Convention for the Protection of Industrial
Property [sine 1965]
- Budapest Treaty on the International Recognition
of the Deposit of Microorganisms for Purposes
of Patent Procedure [since 1981]
- Berne Convention for the Protection of Literary
and Artistic Works [since 1951]
- International Convention for the Protection
of Performers, Producers of Phonographs and
Broadcasting Organizations [since 1984]
- Agreement on Trade-Related Aspects of Intellectual
Property Rights [TRIPS Agreement]
International Conventions
& the Principle of Reciprocity
Under principles of reciprocity "Any
person who is a national or who is domiciled
or has a real and effective industrial establishment
in a country which is a party to any convention,
treaty or agreement relating to intellectual
property rights or the repression of unfair
competition, to which the Philippines is also
a party, or extends reciprocal rights to nationals
of the Philippines by law, shall be entitled
to benefits to the extent necessary to give
effect to any provision of such convention,
treaty or reciprocal law, in addition to the
rights to which any owner of an intellectual
property right is otherwise entitled by this
Act."
